[ 01 ] Scope & Operating Entity

These Terms of Service ("Terms") govern your use of the website https://berlin.zonindex.com and associated spatial analysis services ("Zonindex", "Platform", or "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

[ 02 ] Description of Services

Zonindex offers an algorithmic spatial evaluation platform for the Federal State of Berlin:

Free Spatial Desk: Interactive exploration of Berlin districts, Liveability Index scores, pedestrian access radiuses (200m/500m/1000m), noise exposure indicators, and side-by-side location comparisons.
Paid Urban Due Diligence Dossiers: Comprehensive, downloadable, and printable multi-page dossiers providing granular micro-location data, neighborhood demographics, transit accessibility metrics, and historical urban zoning classifications.

THE LIVABILITY INDEX AND URBAN DUE DILIGENCE DOSSIERS ARE COMPUTATIONAL ESTIMATIONS DERIVED FROM PUBLIC OPEN DATA AND ARE PROVIDED STRICTLY FOR INFORMATIONAL AND PRELIMINARY ORIENTATION PURPOSES.

Zonindex does not provide certified real estate appraisals, structural engineering assessments, environmental guarantees, legal counsel, or financial/investment advice.

Public datasets (such as noise maps, crime rates, tree registers, or social preservation areas / Erhaltungsmilieus) may contain inaccuracies, measurement delays, or reporting lags beyond our control. Users must independently verify all local zoning laws, tenancy regulations, building permits, and property conditions with official municipal authorities, certified surveyors, or licensed legal consultants before entering into rental contracts, real estate acquisitions, or financial investments.

[ 04 ] Purchases & Merchant of Record

All purchases of paid Urban Due Diligence Dossiers are processed and fulfilled through our authorized Merchant of Record:

Lemon Squeezy, Inc.

When placing an order, the legal sales contract is entered into directly with Lemon Squeezy, Inc. Lemon Squeezy is responsible for invoicing, order management, payment security, and compliance with applicable sales tax, VAT (Value Added Tax), and GST regulations.

[ 05 ] Delivery of Digital Content & Statutory Right of Withdrawal (Widerrufsrecht)

Urban Due Diligence Dossiers are digital products generated immediately following transaction completion.

Pursuant to statutory EU consumer protection regulations (e.g. § 356 (5) German Civil Code / BGB and the EU Consumer Rights Directive), you expressly consent to the immediate performance and generation of the digital dossier before the expiry of the standard 14-day statutory withdrawal period. You acknowledge that by giving this consent, you forfeit and lose your statutory right of withdrawal once the digital content has been made available and accessed.

[ 05.1 ] Refund Policy & Technical Failure

Due to the instant delivery nature of digital goods, sales are generally final once the dossier is generated, as outlined in Section 05.

However, customer satisfaction and integrity are paramount. A full refund will be granted via Lemon Squeezy under the following circumstances:

Technical failure resulting in non-delivery or corrupted dossier generation that cannot be resolved within 24 hours.
Duplicate billing or transaction processing errors.

Refund requests must be submitted to info@zonindex.com within 14 days of purchase, citing your order ID. Refunds are issued directly through Lemon Squeezy to the original payment method.

[ 06 ] Intellectual Property & Data Attribution

All proprietary algorithms, user interface designs, frontend code, and visual identities of Zonindex are the exclusive intellectual property of NAVİRİD TEKNOLOJİ ANONİM ŞİRKETİ (NAVIRID TEKNOLOJI A.S.).

Underlying geospatial datasets are utilized under their respective public open data licenses:

Geoportal Berlin / Land Berlin (dl-de/by-2.0)
Copernicus Land Monitoring Service (European Union)
CARTO & OpenStreetMap Contributors (ODbL)
Amt für Statistik Berlin-Brandenburg

[ 07 ] Limitation of Liability

To the fullest extent permitted by applicable law, NAVİRİD TEKNOLOJİ A.Ş. and its directors, employees, or partners shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:

Your use of, or inability to access or use, the Service.
Any financial, lease, tenancy, or real estate decision made in reliance upon scores, maps, or dossiers generated by Zonindex.
Inaccuracies or omissions in governmental Open Data feeds.

[ 08 ] Applicable Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles, subject to mandatory statutory consumer protection laws of your country of habitual residence (EU Consumer Law). The courts of Istanbul (Anadolu) shall have exclusive jurisdiction for disputes arising out of or in connection with these Terms, unless mandatory consumer protection regulations dictate otherwise.
